Course Description

This course will provide you with some practical guidance on how to recognize, avoid and manage conflicts of interest in your legal practice, which will be essential to your success as a solicitor. The course is divided into three parts.

The first part provides an overview of what a conflict of interest is, and identifies some of the common types that arise in legal practice, as well as some of the potential consequences for a solicitor who knowingly engages in them. The second part of the course provides a more comprehensive overview of the rules governing conflicts of interest in Hong Kong, including the Principles of Professional Conduct, the International Code of Ethics for Legal Practitioners, Chapter 9 of the Solicitor’s Guide which deals with Conflicts of Interest, as well as Rule 702 which talks about implications with a Solicitor’s Fiduciary Duty to their client.

The third and final part of the course provides some guidance on how to manage conflicts in your legal practice, including drafting conflicts of interest policy, establishing a conflicts of interest system, and also maintaining conflicts of interest database.

Speaker’s Bio:
This course is taught by Kelly Stone, a lawyer from the United States with more than twelve years of international law experience. Kelly holds a Doctor of Jurisprudence (J.D.) and Bachelor of Arts (B.A.) in Sociology and Philosophy and has been working to strengthen the capacity of both public and private bodies in adhering to obligations under the law. Kelly is well-versed in legal analysis and research and has provided technical expertise in developing legal norms and standards, assessing risk management and strategies, and has assisted government actors in developing policies and protocols relating to safety and security. Kelly is also a certified facilitator and has trained government officials, NGOs, and community leaders on a variety of topics, including law, policy, safety, and development. In addition, Kelly has a demonstrative publication record, which includes peer-viewed journal articles, book chapters, and opinion pieces.
