Course Description

Particular Aspects of Mediation is a course designed for legal professionals seeking to refine their mediation skills by exploring advanced and specialized mediation contexts. This course goes beyond the fundamentals, addressing complex mediation dynamics such as co-mediation, probate and succession disputes, political mediation, and the rising trend of mandatory mediation. Participants will gain insights into when co-mediation is most effective, how to navigate cultural and linguistic barriers, and the strategic benefits of working with multiple mediators in high-conflict cases.

The course also delves into probate mediation, where legal and emotional complexities often intersect, requiring a balance between legal expertise and sensitivity to family relationships. Political mediation, with its distinct power dynamics, media scrutiny, and stakeholder complexity, is examined through case studies such as election dispute resolution. Additionally, the course explores the growing legal landscape of mandatory mediation, with a focus on policy developments in jurisdictions like England, Singapore, and Australia.

A key focus is emotional intelligence in mediation, equipping lawyers with tools to manage emotions, reduce conflict intensity, and facilitate productive negotiations. Participants will learn how emotions influence decision-making, how to separate emotional responses from rational choices, and how to guide parties toward self-persuasion rather than imposed solutions.

This course is essential for legal practitioners who want to expand their mediation capabilities, adapt to evolving dispute resolution trends, and develop the emotional and strategic acumen required for effective mediation. Enroll today to elevate your mediation expertise.
